JUSTICE JYOTI SARAN) 27-09-2018 The writ petition was disposed of with a direction to the Director, Primary Education, Bihar, Patna to consider the claim of the petitioner for upgradation of the Nav Srijit Primary School, Makhanahi Pokhar, Jatahi (Baniya Tola) in the District of Madhubani. Since the order was not complied that the contempt application was filed.
A show cause is filed today on behalf of the opposite party no.2 i.e. the Director, Primary Education enclosing an order dated 25.09.2018, whereby the District Magistrate,
Patna High Court MJC No.2113 of 2017 (4) dt.27-09-2018 Madhubani and the District Education Officer, Madhubani have been directed to take necessary action on the upgradation of the school in question in the light of the resolution passed by the Panchayat Samiti in its meeting held on 05.09.2009 and the stipulations present in the Government Circulars on the issue. In view of the order disposing of the representation passed by the Director, Primary Education, Bihar, Patna the complaint of non-compliance of the order stands redressed. Accordingly the contempt application is disposed of leaving it open for the petitioner, if so advised, to take recourse to such steps as required in the light of the order passed by the Director, Primary Education, Bihar, Patna.
