JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Phulparas P.S. Case No. 60 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

There is recovery of liquor from Splender motorcycle of the petitioner as well as from the Bolero vehicle. Submission of learned counsel for the petitioner is that he was not present there and he has no criminal antecedent. Heard learned APP, who has opposed the prayer for anticipatory bail.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on

Patna High Court CR. MISC. No.71545 of 2019(3) dt.26-11-2019 2/2 its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
