JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Nabinagar P.S. Case no. 108 of 2017, registered under Sections 379 and 411 of the Indian Penal Code and Section 40 of the Bihar Mines Act.

The accusation is that petitioner being the proprietor of Aditya Multicom Pvt. Ltd., Sheoganj Pali road, Dehari-on-Sone engaged in mining of sand after constructing sand ghat in spite of direction to stop the illegal mining of the sand and due to excavation of sand causing heavy loss to the exchequer.

Learned counsel for the petitioner submits that petitioner is neither the proprietor of Aditya Multicom Pvt. Ltd., Sheoganj Pali road, Dehari-on-Sone nor he has connected in any manner to said firm. Further submission is that the petitioner has falsely been implicated in

Patna High Court Cr.Misc. No.37903 of 2017 (3) dt.21-09-2017 2/2 this case only on suspicion. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-I, Aurangabad in connection with Nabinagar P.S. Case No. 108 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
