The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 466, 467, 468, 471, 472, 120B of the Indian Penal Code. As per prosecution case, in connection with Lalganj P.S. Case No. 133 of 2021, wherein, learned counsel on behalf of Sunny Kumar filed several certificates of Sunny Kumar but after verification the same were found to be forged. It is further alleged that these forged documents were produced by this petitioner (father of Sunny Kumar) on payment of Rs. 20 thousand.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted vide
Patna High Court CR. MISC. No.73082 of 2022(2) dt.20-03-2023 2/2 para 12 of the petition that the petitioner has neither knowingly nor intentionally committed such an offence rather a wrong advice was furnished by learned counsel of Sunny Kumar for submission of forged certificate. The learned counsel of Sunny Kumar (co-accused) has already been granted bail by learned Court of C.J.M. Vaishali at Hajipur vide BP no. 3372 of 2022 on 13.9.2022. The petitioner has got no criminal antecedent and languishing in judicial custody since 5.7.2022. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hajipur Town P.S. Case No. 505 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur.
