JUSTICE SANJAY PRIYA ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Lalganj P.S. Case No. 26 of 2018 instituted for the offence under Sections 457 and 380 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is named in the written report on the basis of suspicion. There is no recovery from his possession.
In the written report it is alleged that Motorcycle and some other articles have been stolen from the house of the informant. It is further alleged that petitioner along with other accused persons was seen running away with those stolen articles, but there is no recovery of any articles from his possession.
It is mentioned in paragraph-3 of the bail petition that
Patna High Court Cr.Misc. No.53419 of 2018 (3) dt.01-10-2018 2/2 petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Lalganj P.S. Case No. 26 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
