2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Ganga Bridge P.S. Case No. 184 of 2023 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.
3. The case of the prosecution is that police received secret information that petitioner along with other has concealed illicit liquor in banana field and from that place altogether, 153.375 liters of foreign liquor was recovered by the raiding team.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.78491 of 2024(2) dt.05-12-2024 2/2 the petitioner is innocent and has committed no offence. It is further submitted that nothing has been recovered from the conscious possession of this petitioner.
5. Learned APP appearing for the state has opposed the prayer of anticipatory bail of the petitioner and submitted that petitioner has eleven criminal antecedents of similar nature of cases.
6. Having heard the learned counsel for the parties and considering the facts and circumstances of this case as well as criminal antecedents of the petitioner in similar nature of cases, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for anticipatory bail stands rejected.
7. The petitioner is directed to surrender before learned court below and prays for regular bail, the same shall be considered by the court below, without being prejudiced by the order of this Court.
