Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 420, 188/34 of the Indian Penal Code and 30(a) of Bihar prohibition and Excise Act 2016.

812 liter Indian made foreign liquor is said to have been recovered from the hut situated in front of the house of petitioner.

Submission on behalf of the petitioner is that nothing has been recovered either from the house or from possession of the petitioner and according to the prosecution case itself, the alleged recovery was made in front of the house of petitioner for which petitioner is in jail custody since 05.09.2019 without

Patna High Court CR. MISC. No.72621 of 2019(2) dt.04-12-2019 2/2 having any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 9th Additional Sessions Judge cum Special Judge, Excise, Motihari in connection with Harsidhi P.S. Case No. 207 of 2019.
