JUSTICE RAJESH KUMAR VERMA ORAL ORDER 10-10-2023 Heard Mr. Umesh Kumar, learned counsel for the petitioner, Mr. Rahul Kumar, learned counsel appearing on behalf of the informant as well as Mr. Arun Kumar, learned APP for the State.
2. The petitioner is apprehending his arrest in connection with Jehanabad Mahila P.S. Case No. 12 of 2022, F.I.R. dated 7.04.2022 for the offences punishable under Sections 498A, 379, 506/34 of the Indian Penal Code and Section 4 of the D.P. Act.
3. According to prosecution case, informant was subjected to cruelty by the accused persons including the petitioner due to non-fulfillment of demand of dowry and also ousted her from her matrimonial house.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the
Patna High Court CR. MISC. No.72121 of 2022(4) dt.10-10-2023 2/2 petitioner has not committed any offences as alleged in the F.I.R.
5. Vide order dated 24.02.2023 the matter was referred to the Mediation Centre, Patna High Court for settlement of disputes between the parties. Report of the learned Mediator dated 13.07.2023 reveals that due to non-cooperation of the petitioner as he never appeared in the mediation proceeding, the mediation process has failed.
6. The learned counsel appearing on behalf of the informant as well as learned Additional Public Prosecutor have vehemently opposed the prayer for bail of the petitioner.
7. Considering the aforesaid facts and circumstances as well as report of the learned Mediator, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Jehanabad Mahila P.S. Case No. 12 of 2022 pending in the court of Sub Divisional Judicial Magistrate, Jehanabad.
8. Prayer is refused.
