The petitioner seeks bail in Sarai P. S. Case No. 114 of 2018 instituted for the offence under Section(s) 414, 413/34 of the Indian Penal Code.
Petitioner has clean antecedent. Petitioner is in custody since 6.6.2018. The other accused, namely, Md. Jafar Iqbal, with similar allegation. has already been granted regular bail by coordinate Bench of this court by order dated 19.9.2018 passed in Cr. Misc. no. 53871 of 2018.
In the written report, is alleged that this petitioner with Md. Zafar Iqbal and other accused persons were apprehended by the police along with three motorcycles which
Patna High Court Cr.Misc. No.55596 of 2018(3) dt.05-10-2018 2/2 are alleged to be stolen motorcycles.
From the written report it does not appear that which of the motorcycle has been recovered from possession of this petitioner. It appears that there is general and omnibus allegation that three motorcycles have been recovered from possession of petitioner and other accused persons as mentioned in the written report.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM XIII, Vaishali at Hajipur in connection with Sarai P. S. Case No. 114 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
