Petitioner seeks bail in Kochas (Parasthua) P.S. Case No.113 of 2018 instituted for the offence under Section(s) 341, 323, 342, 504, 506, 379, 354-A, 354-B Indian Penal Code and Section 8/12 of the POCSO Act.

In the written report, it is alleged that on the date of occurrence the Informant was going to her school and on the way this petitioner caught hold her near his shop and locked her in the shop and started to do wrong act with her. On protest, the petitioner abused her and assaulted. On halla, many persons including father and mother of the informant arrived. Counsel for the petitioner submits that there were

Patna High Court Cr.Misc. No.53104 of 2018 (3) dt.27-09-2018 2/2 some dues of the petitioner with the informant as the petitioner was having mobile shop. When he made demand of the dues, the informant has lodged this false case. Petitioner is in custody since 11.07.2018.

From the written report itself, it appears that no injury has been caused to the informant.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 1st, Rohtas, in connection with Kochas (Parasthua) P.S. Case No.113 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
