Petitioner seeks bail in Benipatti P.S. Case No. 229 of 2017 registered for the offence punishable under Sections 356 and 379 of the Indian Penal Code.
Informant has alleged snatching of Rs. 2,60,000/- from his possession when he was returning after withdrawing the said amount from the Bank. FIR is against unknown. It has been submitted on behalf of the petitioner that the name of the petitioner has surfaced in this case on the basis of confessional statement made by co-accused Kamlesh Kumar. It has been further submitted that similarly, situated co-accused person namely Chandan Kumar has been granted anticipatory bail vide order dated 03.07.2018 in Criminal Miscellaneous No.
Patna High Court Cr.Misc. No.50129 of 2018(3) dt.14-09-2018 2/2 38319 of 2018 and another co-accused namely Brajesh Kumar Thakur has been granted regular bail vide order dated 31.07.2018 in Criminal Miscellaneous No. 43230 of 2018. Except the confessional statement there is no incriminating material against the petitioner. Nothing has been recovered from the possession of the petitioner. Petitioner is in custody since 21.06.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti, Madhubani, in connection with Benipatti P.S. Case No. 229 of 2017.
