2. The petitioner is apprehending his arrest in connection with Sidhwaliya P.S. Case No. 136 of 2024, lodged on 10.05.2024, under Section 414 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against two named accused persons including the present petitioner. Upon recovery of the motorcycle by the police, the arrested person disclosed that he had purchased the motorcycle from the petitioner

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel for the petitioner submits that name of the petitioner has been figured in this case by virtue of confessional statement of the

Patna High Court CR. MISC. No.75637 of 2024(2) dt.11-11-2024 2/2 co-accused from whose possession the motorcycle was recovered, as he had disclosed that he purchased the motorcycle from the petitioner. Counsel further submits that the antecedent of the petitioner is clean and he is accused for the offence under Section 414 of the IPC which is magisterial triable.

5. Learned APP for the State opposes the prayer for bail and submits that the petitioner used to sell the motorcycle which was subject to theft.

6. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judical Magistrate-I, Gopalganj in connection with Sidhwaliya P.S. Case No. 136 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
