JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The petitioner is in jail custody since 20.9.2019 on the accusation that 40 literes Indian made liquor kept in several bottles were recovered from a bag, which was allegedly in conscious possession of the petitioner.

Submission on behalf of the petitioner is that according to the prosecution case itself, the alleged recovery was made from a bag, which had been kept on Railway Platform and, moreover, the petitioner does not have any criminal antecedents.

No.66201 of 2019(2) dt.24-10-2019 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - cum - Special Judge, Excise, Katihar, in connection with Katihar Rail P.S. Case No. 76 of 2019.
