Heard learned counsel for the petitioner.

The petitioner prays for bail in connection with Nawada (Town) P.S.Case No. 195 of 2018 registered for the offences punishable under Sections 498A and 304B/34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be husband of deceased, is of causing dowry death to the deceased. Submission of learned counsel for the petitioner is that FIR itself shows that she had committed suicide by hanging and the door was closed from inside and police recovered the dead body. Further submission is that witnesses have also disclosed that

Heard learned APP also, who has opposed the prayer for bail stating that as there was illicit relationship with the petitioner and his sister-in-law as such she committed suicide. Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nawada (Town) P.S.Case No. 195 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
