2. The petitioner has preferred this application for grant of regular bail in connection with Buniyad Ganj P.S. Case No. 65/2021 dated 19.04.2021 registered for the offences punishable u/ss 147, 148, 149, 341, 323, 386, 302, 379 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the informant has alleged that the petitioner along with others surrounded his brother, namely, Ranjan Kumar and on the instigation of the coaccused, Sintu Kumar, the co-accused, Durga Mahto fired upon the brother of the informant due to which he died.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.71667 of 2025(2) dt.28-11-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The specific allegation of firing is against the co-accused, Durga Mahto. The other co-accused person has already been granted bail by the co-ordinate bench of this court vide order dated 27.07.2023 passed in Cr. Misc. No. 31686/2023. The petitioner has two antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 24.07.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gaya in connection with Buniyad Ganj P.S. Case No. 65/2021, with the condition:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled.
