The petitioner seeks bail in Marhowrah (Gaura O.P.) P.S. Case No. 116/2017, instituted for the offences under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that there is case and counter case between the parties on account of land dispute. Present case is counter blast of Marhowrah (Gaura O.P.) P.S. Case No. 113/2017, which has been lodged by coaccused Sonu Kumar (brother of this petitioner) against informant and others.

In the instant case, there is allegation against this petitioner that he assaulted the son of informant with sword

Patna High Court Cr.Misc. No.53779 of 2018 (3) dt.02-11-2018 2/2 causing injury on his head.

Injury report is available in case diary, wherein doctor has found simple injury on the person of informant. Son of informant, namely, Vijay Singh has sustained four injuries, out of which one injury is opined to be grievous in nature, which is described as pain over right hand and wrist.

Petitioner is in custody since 23.07.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Marhowrah (Gaura O.P.) P.S. Case No. 116/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J.) Rakhi U T
