JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-10-2018 The petitioner is in custody since 10.10.2015 in connection with Falka P.S. Case No. 249 of 2015, arising out of S.T. No. 46 of 2016, registered for offences punishable under Sections 342, 448, 324, 302/34 of the Indian Penal Code and Section 3/4 of Prevention of Witch Practice Act. Allegation against the petitioner is of assault to the deceased by lathi and danda. It further appears that earlier prayer for bail of the petitioner was rejected vide order dated 17.02.2016 passed in Cr. Misc. No. 56310 if 2015.

Submission of learned counsel for the petitioner is that the petitioner is in custody for three years and there is no likelihood of conclusion of trial in near future. Heard learned A.P.P. also.

No.55306 of 2018 (4) dt.11-10-2018 2/2 Having heard both sides, considering the aforementioned facts and circumstances and on perusal of the impugned order it appears that seven witnesses have examined and informant has partly been examined, in such view of the matter, I am not inclined to grant bail to the petitioner. Hence, it is dismissed.

However, since he is in custody for three years, learned Trial Court is directed to conclude the trial as expeditiously as possible.
