The petitioner seeks bail in connection with K. Hat (Sahayak) P.S. Case No.658 of 2019/Special Excise Case No.783 of 2019 registered under Sections 272, 273 and 420 of the Indian Penal Code besides Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016. The accusation is that in course of the search of the house of Mithilesh Kumar Lakhmani, several bottles of Indian Made Foreign Liquor in the volume of 1615.56 liters were recovered, whereas from his vehicle, 84 bottles each containing 750 ml. Indian Made Foreign Liquor were recovered. The petitioner along with others was apprehended on the spot.

No.67397 of 2019(2) dt.27-11-2019 2/2 Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is the driver of Mithilesh Kumar Lakhmani and he has no concern with his illicit business of liquor. The petitioner in the present case is in custody since 07.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge, Excise, Purnea, in connection with K. Hat (Sahayak) P.S. Case No.658 of 2019/Special Excise Case No.783 of 2019. (Rajendra Kumar Mishra, J) P.S./- U T
