The petitioner apprehends his arrest in connection with Complaint Case No. 4440(c) of 2013 registered under Sections 420 of the I.P.C. and 138 of the N.I. Act pending in the Court of A.C.J.M., Patna.

Submission is that petitioner is a distributor of the company. He is innocent and has falsely been implicated in this case due to ill motive.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that there is

Patna High Court Cr.Misc. No.42353 of 2017 (4) dt.23-11-2017 2/2 direct allegation against the petitioner and the witnesses have also supported the prosecution case.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
