JUSTICE SANJAY PRIYA ORAL ORDER 27-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Manihari P.S. Case No. 26 of 2015 instituted for the offence under Sections 302 and 201/34 of the Indian Penal Code.

Counsel for the petitioner submits that First Information Report is against unknown. Petitioner has been arrested in the instant case merely on suspicion. The Sessions Judge has mentioned in the impugned order that in paragraph-10 of the case diary it is mentioned that petitioner is said to be last seen with the deceased. Petitioner is said to be in custody since 21.06.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.53326 of 2018 (3) dt.27-09-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Manihari P.S. Case No. 26 of 2015, subject to the condition that both the bailors will be the close relatives of the petitioner.
