Petitioners apprehend their arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Prosecution's case in short is that the petitioner and other accused persons named in the FIR were engaged in illegal sand mining.

Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case. Petitioners are neither owner of the tractor and motorcycle nor

Patna High Court CR. MISC. No.66989 of 2019(3) dt.05-03-2020 2/2 they are concerned with the illegal mining. Similarly situated co-accused have already been allowed bail by a bench of this Court vide order dated 2.9.2019, passed in Cr.Mis.No. 55537/2019 (Annexure 3).

Considering the facts of the case, let the petitioners, above named, in the event of surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Koilwar Police Station Case No. 202/2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
