JUSTICE SHAILENDRA SINGH ORAL ORDER 16-10-2025 At the outset, considering the prayer made by learned counsel for the petitioner, he is permitted to make necessary formal correction in the paragraph no.1 of the petition in the course of day.

2. Heard Mr. Shailendra Kumar Jha, learned counsel for the petitioner and Mr. Md. Nazir Ansari, learned APP for the State.

3. The petitioner seeks regular bail in connection with Rail P.S. Jaynagar Case No. 43 of 2025 corresponding to G.R. No. 1177 of 2025 dated 03.09.2025 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

4. The main submissions advanced by the petitioner's

No.73673 of 2025(2) dt.16-10-2025 2/3 counsel are that as per the prosecution, four plastic bags containing 66 litres liquor were recovered from the platform of Jaynagar railway station and in the FIR it has been wrongly alleged that the petitioner was carrying those bags and threw the same upon seeing the police party and started fleeing, in fact the petitioner was apprehended merely on suspicion when she was leaving the platform. It is further submitted that the police failed to make any independent person a witness to the seizure despite the recovery having been made on a railway platform where several persons ordinarily remain present. It is further submitted that the petitioner is a lady and her past is completely clean, she has never remained involve in any offence punishable under the Excise act in the past.

5. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

6. Considering the above stated facts and mainly the petitioner's fair and clean antecedent and also her aforesaid defence as well as her custody period, this court is inclined to release her on bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Rail P.S. Jaynagar Case No. 43 of 2025 corresponding to G.R. No. 1177 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand)
