The petitioners are apprehending their arrest in connection with Complaint Case No. 2333C of 2016 for the offence under Sections 406, 323, 504, 417 of the Indian Penal code.
After some arguments, the learned counsel for the petitioners seeks permission to withdraw the present application for grant of anticipatory bail on behalf of petitioner no.1. However, withdrawal of the anticipatory bail application will not cause prejudice to the petitioner no.1 and in the event, the petitioner no.1 surrender before the Court below and prays for
Patna High Court Cr.Misc. No.53965 of 2018(3) dt.12-12-2018 2/2 regular bail, the Court below is hereby directed to dispose of the application for regular bail of the petitioner on the same day in accordance with law without being prejudice by this order. Considering the allegation involved in the present case and the role attributed to the petitioner No.2 who aged about more than 60 years, let the petitioner No.2 above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of Learned Additional Chief Judicial Magistrate, VI, Begusarai in connection with Complaint Case No. 2333C of 2016, subject to the conditions as laid down under Section 438 Cr.P.C.
