Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
At the outset, learned counsel for the petitioner has submitted that he has filed an affidavit stating therein that the petitioner has been terminated from the post of Niyojeet Panchayat Teacher.
The petitioner is apprehending his arrest in connection with Birpur P. S. Case No. 158 of 2022 registered for the offences punishable under Sections 420, 467, 468, 471 and
Patna High Court CR. MISC. No. 74248 of 2022(3) dt.28-02-2023 2/3 120B of the Indian Penal Code.
As per the prosecution case, the petitioner has got appointment as Niyojeet Panchayat Teacher on the basis of forged matriculation certificate.
Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. No such occurrence as alleged has ever taken place. The petitioner is a lady and she never indulged in such type of case. Learned counsel further submitted that the petitioner has already been terminated from the said service. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. Learned A.P.P. for the State has fairly submitted that the petitioner has already been terminated from the post of Niyojeet Panchayat Teacher.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Birpur at Supaul in connection with Birpur P. S. Case No. 158 of 2022, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
