The petitioner seeks bail in Nayagaon P.S.Case No.7 of 2018 registered for the offences under Sections 457 and 380 of the I.P.C.

Allegation as per the F.I.R. against the petitioner is of theft of various arms and ammunitions from the police Malkhana. Submission on behalf of the petitioner is that there is alleged recovery of one country made pistol and one mobile from the petitioner. However, other co-accused person having similar allegation has been granted bail vide order dated 27.8.2018 passed in Cr.Misc. No.49989 of 2018. The petitioner is in custody since 10.04.2018 having no criminal antecedent and charge sheet has been submitted.

Having heard both sides and in view of the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Begusarai, in Nayagaon P.S.Case No.7 of 2018 subject to the condition that one of the bailors must be of local person having sufficient properties within the jurisdiction of the court concerned.
