The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 409 and 420 of the Indian Penal Code which was earlier rejected vide order dated 28.01.2025 with an observation that the petitioner will be at liberty to renew his prayer for bail after six months, if so advised.

3. The case of the prosecution is that the informant is proprietor of Aman trader and he used to purchase paddy like wheat and rice from farmer and store the same. In financial year 2022-23, the informant stored paddy and in the month of November, petitioner approached the informant, declaring

No.75574 of 2025(2) dt.31-10-2025 2/3 himself as the in-charge of Bihar State Seed Corporation, Buxar, showing his I-card and told that he has to purchase paddy crops at the rate of Rs. 2040 per quintal and the same has to be kept in government godown. On this the informant got ready and on 18.11.2022 from truck no. BR23C-4158, 252.70 quintal at Rs. 5,15,508 and on truck no. UP54D-4087, 236.50 quintal at Rs. 4,82,460 and on 19.11.2022, from truck no. BR44G-0316, 211.10 quintal at Rs. 4,30,644 and on truck no. UP-60 K-9837. 245.60 quintal at Rs.5,01,024 which total amount to Rs.19,29,636 of paddy was purchased from the informant. He mentioned his mobile no and Pan card no which was written on the bill. He also promised that the cash to be collected after one week.

When the petitioner was contended after a week, he further demanded time of one week. When the price of the paddy was not given to the informant he went to Bihar State Seed Corporation, Buxar and found that the godown was closed and on enquiry from the other shop keepers, he came to know that the name of the petitioner is Ajit Kumar and he is a resident of Muzaffarpur. The informant went to that address and the petitioner said that by 27.12.2022, the cash will be in his account.

Patna High Court CR. MISC. No.75574 of 2025(2) dt.31-10-2025 3/3 know that the petitioner has also committed cheating with Chaitanya Singh and Ajatshatru in like manner. Learned counsel for the petitioner has submitted that till today, charge has not been framed in this case. This offence is triable by Magistrate. Moreover, the petitioner is languishing in judicial custody since 15.12.2023.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the above facts and circumstances of this case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Murar P.S. Case No. 46 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Buxar Court No. 11.
