JUSTICE SANJAY PRIYA ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Balua Bazar P.S. Case No. 32 of 2018 instituted for the offence under Sections 457 and 380 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is in custody since 28.06.2018. He is not named in the written report. His name has come in the confessional statement of co-accused Md. Israfil from whose possession one Black colour Double SIM Samsung Mobile is alleged to have been recovered. Police during investigation has arrested the petitioner on the ground that one Black colour Samsung Mobile has been recovered from possession of the petitioner. No Test Identification Parade of any article has been conducted.

Patna High Court Cr.Misc. No.53490 of 2018 (3) dt.01-10-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Supaul, in connection with Balua Bazar P.S. Case No. 32 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
