JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Bihar P.S. Case No. 54 of 2014 for the offence under Sections 406, 420, 120(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the entire case is concocted and false and the petitioner has not received even a single penny from the informant. Considering the allegation that the informant has paid Rs.55,000/- to the petitioner in connection with pass-port and Visa and petitioner has no criminal antecedent, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released

Patna High Court Cr.Misc. No.53867 of 2018(3) dt.12-12-2018 2/2 on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Bihar Sharif in connection with Bihar P.S. Case No. 54 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with the further condition that the petitioner shall extend full co-operation in conclusion of the trial and shall appear before the court below on each and every date and in the event of failure of the petitioner to appear on the date fixed in the trial, the trial court is at liberty to cancel the bail bonds of the petitioner.
