Learned counsel for the petitioner submits that the prayer for bail of the petitioner has earlier been rejected vide order dated 29.02.2024 passed in Criminal Miscellaneous No.68627/2023 with liberty to the petitioner that he may renew his prayer for bail nine months after framing of charge. Learned counsel further submits that the charge in this case was framed on 19.04.2023 and more than nine months have elapsed since then.
3. Learned counsel for the State opposes the prayer for bail and submits that, on an earlier occasion, a report regarding the present stage of the trial had been called for.
4. Upon perusal of the report dated 16.10.2025,
Patna High Court CR. MISC. No.72211 of 2025(3) dt.03-12-2025 2/2 containing Letter No. 242 from the I/c District and Additional Sessions Judge-III, Madhubani, it transpires that the charge in this case was framed on 19.04.2023 and, out of six witnesses, five have already been examined. The case is now pending for prosecution evidence. Under these circumstances, it appears to this Court that no useful purpose would be served by keeping the petitioner in custody.

Accordingly, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of learned Additional Sessions Judge-V, Madhubani in connection with Bisfi P.S. Case No. 153 of 2022 (ST No. 99 of 2023), subject to the conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
