The petitioner seeks bail in a case registered under Sections 147, 148, 149, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is that the accused persons including the petitioner fired upon the father of the informant with arms, due to which he sustained injuries and fell down. He was taken to the Hospital for treatment, where the doctor declared him dead. It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.5.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is said to be a member of

Patna High Court Cr.Misc. No.50334 of 2018(3) dt.13-09-2018 2/2 unlawful assembly. No overt act has been alleged against the petitioner. The main allegation is against co-accused, namely, Brajesh Yadav, Chhabilal Yadav and Sintu Yadav. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. 2nd, Navgachhia, District Bhagalpur in connection with Navgachhia P.S. case No.116 of 2018.
