2. The petitioner apprehends his arrest in a case registered for offence under Sections 302/34 of the Indian Penal Code.
3. It is alleged that this petitioner alongwith other accused persons committed death of informant's sister.
4. Learned counsel for the petitioner submits that petitioner happens to be husband of the deceased and has been falsely implicated in this case only on suspicion. As a matter of fact, the deceased died due to accident, as being mentally ill, she went anywhere outside the house and slipped in the pond. To this effect, an application was filed by Dipak Thakur, son of the
Patna High Court CR. MISC. No.79209 of 2023(7) dt.01-05-2024 2/2 deceased, addressed to Sr.S.P., Darbhanga, stating therein that nobody has killed his mother, rather his mother died due to drowning (Annexure 2 to the bail petition). Petitioner has got clean antecedent.
5. However, learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that petitioner is husband of deceased and there is specific and direct allegation against him in the F.I.R. as well as case diary.
6. Considering the nature and gravity of the offence and the fact that petitioner is husband of the deceased and deceased died in an unnatural circumstances, the prayer for anticipatory bail of petitioner is rejected.
