The petitioner has prayed for regular bail in a case instituted for the offence under Sections 147, 148, 149, 141, 323, 307, 504 and 506 of the Indian Penal Code and later on added Section 302 of the I.P.C.

The allegation against the petitioner along with others is of assaulting the father-in-law of the informant namely, Bala Mushar, due to which he succumbed to injury.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. He submitted that petitioner is the next door neighbor and both are Gotia. There is general and omnibus allegation against the petitioner and no specific overt act of

Patna High Court CR. MISC. No.73514 of 2022(3) dt.24-04-2023 2/2 assaulting to the deceased against this petitioner. He is languishing in judicial custody since 10.06.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-cum-Sub Judicial Magistrate, Bikramganj (Rohtas) in connection with Dinara P.S.
