====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 09-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code. According to FIR, the informant had some dispute with Lakhan Bishwas relating to some land. Lakhan called the informant for a Panchayati and at Panchayat, it is alleged that the named accused persons committed assault against the informant. When the informant was fleeing back, some others, under leadership of Shankar Kushwaha, came there and committed assault against the informant. The petitioner also allegedly committed assault with lathi.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.73164 of 2019(2) dt.09-12-2019 2/2 allegation is general and omnibus. For the same occurrence, six cases were registered in the same police station and in one of that case, namely, K. Hat P.S. Case No. 293 of 2019, co-accused Sushant Kushwaha has already been allowed anticipatory bail by a Coordinate Bench of this Court vide order dated 05.11.2019 passed in Cr. Misc. No. 69424 of 2019. Considering the fact that the allegation is general and omnibus against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.

20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Sahayak) Police Station Case No. 291 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
