2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 285 , 287 , 304 of I.P.C . of the Indian Penal Code.

3. As per the prosecution case , while the brother of the informant was connecting wire in motor, petitioner Sonu Kumar supplied electricity due to which his brother died from electrical shock .

4. It is submitted on behalf of the petitioner that he has been falsely implicated due to old enmity and village politics. No electric wire allegedly used in the electric motor has been seized or recovered from the house of the petitioner. There is no evidence against this petitioner as to which place the

Patna High Court CR. MISC. No.80596 of 2023(5) dt.09-04-2024 2/2 deceased suffered electric shock, and as such, no case of causing death by negligence is made out against this petitioner. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and clean antecedent of the petitioner, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM , Muzzaffarpur in connection with Ahiyapur P.S. case No. 759 of 2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
