The petitioner seeks bail in Turkauliya P.S. Case 14 of 2018 instituted for the offence under Sections 461 and 379 of the Indian Penal Code. Subsequently, Section 411 of the Indian Penal Code was added.
Counsel for the petitioner submits that petitioner has clean antecedent.
The informant alleged in the written report that on the date of occurrence he opened the shop and found all the articles missing from his shop. The name of petitioner has come in the confessional statement of co-accused Bhola Kumar.
Patna High Court Cr.Misc. No.54060 of 2018 (3) dt.12-10-2018 2/2 Counsel for the petitioner submits that co-accused Dharmesh Kumar with similar allegation has already been granted bail by this Court vide order dated 20.09.2018 passed in Cr. Misc. 55595 of 2018.
Counsel for the informant has appeared and opposed the prayer for bail.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkauliya P.S.
