ANJANA MISHRA ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody in connection with the present case registered under Section 392 of the I.P.C. on his remand on 26.7.2017.
It appears that earlier the petitioner was taken into custody in connection with Vaishali P.S. Case No.136 of 2016, in which he has been since granted bail on 25.11.2016 in Cr.Misc. No.50896 of 2016.
Learned counsel for the petitioner submits that though the petitioner is not named in connection with the present F.I.R., later on it has been alleged that the petitioner was speaking with the mobile phone so looted in connection with
Patna High Court Cr.Misc. No.48590 of 2017 (2) dt.17-10-2017 2/2 the present case. He further submits that such allegation cannot stand the test as on the said date, the petitioner was already in custody.
Considering the aforementioned facts and circumstances and the nature of allegations made, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Singhwara P.S. Case No.182 of 2015.
