1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Maharajganj Police Station Case No. 57 of 2024, dated 28.02.2024, disclosing offences punishable under Sections 341/323/307/447/504/34 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that on 28.02.2024, while the informant was sitting at his door, his neighbour, the petitioner, along with other co-accused persons arrived there with lathi, farsha, iron rod, etc., started abusing and assaulting the informant. It has been alleged that co-accused Mannu Kumar assaulted the informant on his head by means of farsha and the

4. Learned Counsel for the petitioner submits that both the parties are neighbours and the occurrence has taken place due to throwing of garbage in front of the house of the informant. The injury caused to the informant on is head is grievous in nature, attributable to co-accused Mannu Kumar and the injury caused to the informant by the petitioner near his nose is simple in nature, which would be evident from the injury report, mentioned in the impugned order.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that both the parties are neighbours and the injury attributable to the petitioner near the nose of the informant is simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties
