JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 379 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, co-accused, Sonu Kumar assaulted the informant with iron rod thereafter this petitioner and other accused persons also assaulted him. It is further alleged that co-accused Sonu Kumar assaulted his brother with iron rod causing head injury and other accused persons assaulted him with cycle chain and danda. Co-accused, Manohar Kumar, snatched gold chain from the brother of informant. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that specific accusation of assault is

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and nature of accusation against the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateIII, Vaishali at Hajipur in connection with Patepur PS case No. 182/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
