JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-10-2018 Heard learned counsel for the petitioner and the State. The petitioner is an accused in a case under Section 376 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the victim girl.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He is shopkeeper and the victim used to take away house hold article worth Rs. 6000/ which was due and furthermore the falsity of the case also appears as the statement of the victim girl has not been recorded under Section 164 of the Cr.P.C. and also she has not appeared before the medical board. The petitioner is in custody since 06.07.2018.

Patna High Court Cr.Misc. No.54603 of 2018 (3) dt.09-10-2018 2/2 Heard learned APP appearing for the State also. In view of the fact and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City in connection with Khajekalan P.S. Case No.197 of 2018 with condition that one of the bailors of the petitioner must be a local bailor.
