2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 307, 506/34 of the Indian Penal Code.

3. As per allegation in the FIR, 11 year old son of the informant, namely, Md. Alftab went missing from Yadupatti Bazar. On next date one lady provided information to the informant about an injured boy lying on the roof of Flood relief Building.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to previous enmity. There is no specific allegation of assault against the petitioner. It is mentioned in para 9 of the petition,

Patna High Court CR. MISC. No.75349 of 2023(2) dt.29-11-2023 2/2 that as per injury report, only multiple lacerated wounds were found on the scalp of the injured. Petitioner has got no criminal antecedent and languishing in judicial custody since 01.07.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail after framing of charge. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Madhepura in connection with Kumarkhand P.S. Case No. 161 of 2023.
