2. The present writ petition has been filed for quashing the impugned order dated 28.10.2016 passed by the Sub-Divisional Officer, Danapur vide memo no. V-82-15-1169 by which the licence of the petitioner's Fair Price Shop bearing No. 46 of 2007 has been cancelled; and for further direction to the respondent to restore the license of the petitioner.

3. At the very outset, learned counsel for the petitioner states that an appeal against the impugned order of cancellation has been filed on 26.11.2016 before the Collector, Patna which is still pending.

4. In the counter affidavit filed on behalf of the respondents, it has been stated that the petitioner's appeal No. 33 of 2016-17 was listed "For Admission" on 30.11.2017 and would be disposed of in accordance with law.

5. Having regard to the nature of the grievances of the petitioner, the writ petition stands disposed of. This Court expects that the Collector would dispose of the petitioner's appeal No. 33 of 201617 without undue delay on its own merits and in accordance with law.
