JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 20-07-2018 In para 6 of the order passed in L.P.A. 687/2014 on 03.05.2016 the following directions have been issued: We have heard learned counsel for the parties and find that the present Letters Patent Appeal is required to be disposed of in the light of the order passed by the Single Bench of this Court on 10th of April, 2012 in C.W.J.C. No. 1727 of 2009 (Saraswati Bhawan Jai Kant Madhyamik Sanskrit Vidyalaya, Chikna Vs. The State of Bihar & Ors.) with a direction to the Bihar Sanskrit Shiksha Board for considering the availability of the infrastructure for the purpose of recognition. Once the Board finds that the institution of the appellant is not deficient in infrastructure or is capable of meeting out the deficiencies, the Bihar Sanskrit Shiksha

Patna High Court MJC No.2871 of 2017 dt.20-07-2018 2/2 Board will make recommendation to the State for necessary orders; otherwise, the appellant will be informed of the deficiencies to enable the appellant to take recourse to the remedies in accordance with law.

Now from the counter affidavit filed by the State Government and the Board we find that based on the inspection conducted, the matter was referred by the State Government along with the inspection report to the Board and the Board by a detailed order passed vide the annexure 'E' on 30.05.2018 the Board has issued a show cause notice pointing out the deficiencies to the institute in question and they have been directed to remove the same and inform the Board.

That being so, now we are not inclined to proceed in the matter any further. The proceedings are dropped and the parties granted liberty to raise their grievance in accordance with law.
