JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-01-2020 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Nowkothi P.S. Case No. 28 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

The gist of the prosecution case is that on 24.03.2019 at about 10.25 am, there was hot exchange of words between husband of the informant his brother Ram Prakash Paswan (petitioner) took place due to land dispute. Thereafter, this petitioner and his son Vishal Kumar assaulted husband of the informant with knife and axe, as a result of which, he sustained injuries on his chest and waist and during course of treatment he died.

Considering the facts aforesaid, I am not inclined to
