2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 126 ( 2 ), 115 ( 2 ), 351 ( 2 ), 352, 109, 118 (1) , 329 (3), 324 ( 4 ), 324 (5), 303 ( 2 ) and 191 ( 2 ) of BNS.

3 . As per F.I.R. during measurement and demarcation of land, a free fight took place in which both sides sustained injuries. Case and counter case . Admittedly, there is land dispute between the parties and both parties are in litigating terms with each other. Injuries sustained by the injured are simple in nature . Similarly situated co-accused persons have already been granted bail by this Hon'ble court vide order dated 15.10.2025 passed in Cr. Misc. No. 72288 of 2025 .

4. Learned counsel for the State opposed the bail petition .

5 . Considering the aforesaid facts, nature of injury and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Benipur Darbhanga in connection with Bahera P.S. Case No. 204 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
