The petitioner seeks regular bail in connection with S. T. No.253 of 2015 arising out of Narpatganj P.S. Case No.214 of 2013 registered for offences punishable under Sections 302/34 of the Indian Penal Code.
Allegation as per FIR is assault of the deceased by the petitioner and there is also allegation of another five accused person who assaulted the deceased.
Submission of the learned counsel for the petitioner is that informant is not eye witness and no witnesses have been stated about the assault by the petitioner though the allegation of assault is against other accused persons. Petitioner is custody for more than 3 years eight months.
Patna High Court Cr.Misc. No.58679 of 2018 (3) dt.12-10-2018 2/2 Heard learned A.P.P. also who has opposed the prayer for bail staying that there is allegation of assault and impugned order itself shows that trial is in progress and eight weeks have already examined in this case.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, learned trial Court is directed to expedite the trial and try to conclude the same as soon as possible. (Vinod Kumar Sinha, J) Sanjeev/- U T
