1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 190, 121(1), 122(2), 109, 132, 262, 324(4), 324(5), 352 and 125 of the BNS, 2023.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that Anil was arrested and on inquiry disclosed that about one month back, he purchased a tractor for Rs. 1 Lakh from Lalan and the tractor was then sold to Shubham, thereafter

No.71670 of 2025(2) dt.15-10-2025 2/3 Shubham was arrested and the tractor was noticed near the hill, but Shubham was not able to produce any documents, it is next alleged that thereafter 15-20 accused reached the place of occurrence on 8-10 bikes and freed the apprehended accused and they also brick batted causing injury to police personnel and policeman, Manoj became unconscious, further local people disclosed the name of the accused including the petitioners.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant, it is next submitted that petitioners are not named in the FIR and they have been implicated in the instant case at the instance of local people as alleged in the FIR, but then the name of the person who disclosed the name of the petitioners is not disclosed in the FIR which casts an aspersion on the case of the prosecution. It is further submitted that Raj Ballam Singh @ Lalo Singh @ Raj Ballabh Singh is the named accused in the FIR who is alleged to have participated in the occurrence of assaulting the police personnel and he had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 70932 of 2025 and the same came to be allowed by an order dated 08.10.2025 passed by a learned Co-ordinate Bench. It is next submitted that case of the petitioners is on a better footing.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Gaya Muffasil P.S. Case No. 454 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. Accordingly, the instant anticipatory bail application is allowed.
