The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 193 of 2019, registered under Sections 376, 504 and 506/34 of the Indian Penal Code and Section 4/6 of the POCSO Act.

The accusation is that on 24.08.2019, at about 3 P.M., informant, Neha Kumari, was alone in her house. At that time, Jitu Kumar, entered in her house and committed rape and moved from there giving threatening to not inform anyone. Thereafter, her parents came then she narrated the incident to her parents. When her parents went at the house of Jitu Kumar then Surpanch, Ram Pravesh Ram (petitioner) came there and

Patna High Court CR. MISC. No.67309 of 2019(2) dt.14-11-2019 2/2 asked to settle the dispute in the Panchayat due to that reason, she came at Police Station on 26.08.2019.

Learned counsel for the petitioner submits that it would appear from the FIR that the allegation of committing rape with the informant is against co-accused, Jitu Kumar and it is alleged in the FIR that this petitioner being the Surpanch asked the parents of the informant to settle the dispute in the Panchayat. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge-cum-Special Judge, Aurangabad, in connection with Muffasil P.S. Case No. 193 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
