Learned counsel for the petitioner submits that the petitioner has approached this Court with a limited prayer for early disposal of Title Eviction Suit No. 01 of 2021 pending before the court of learned Munsif, Teghra, Begusarai. Learned counsel further submits that the evidence of the petitioner/plaintiff was closed on 01.11.2023 and thereafter, at the request of defendants, adjournments are liberally granted. Though the defendants have examined 7 witnesses, further time

Patna High Court C.Misc. No.1178 of 2024(2) dt.29-10-2024 2/2 is being granted to the defendants for adducing the evidence. The defendants are trying to delay the disposal of the eviction suit. Initially the defendants avoided appearance despite proper service of notice and thereafter, service through publication was resorted to and after which they appeared in the case.

3. Since the petitioner has approached this Court only with a limited prayer for early disposal of Title Eviction Suit No. 01 of 2021, I do not think there is any need to issue notice to the respondents.

4. Having regard to the facts and circumstances, learned Munsif, Teghra, Begusarai is directed to take up the matter on urgent basis for early disposal of Title Eviction Suit No. 01 of 2021 and dispose of the same preferably within a period of six months from the date of receipt/production of a copy of this order without granting unnecessary adjournment to either of the parties.

5. With the aforesaid direction, the present petition stands disposed of.
