2. The petitioner is apprehending his arrest in connection with Taraiya P.S Case No. 422 of 2021 dated 23.12.2021 registered for the offence punishable u/ss 341, 323, 504, 366A read with Section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have kidnapped the informant's sister from his house forcibly.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.75830 of 2024(2) dt.18-04-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. There is general and omnibus allegation against the petitioner. There is no specific overt act against the petitioner. As per the medical report of the victim, there is no evidence of sexual intercourse. The petitioner has no concern with alleged offence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The co-accused persons have been granted regular bail by this Court vide order dated 13.09.2024 passed in Cr. Misc. No. 46724 of 2024.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for anticipatory bail of the petitioner by submitting that the victim is a minor girl. The victim in her statement recorded under Section 164 of the Cr.P.C. has stated the name of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the specific and heinous nature of offence against the petitioner, I am of the view that no case for grant of anticipatory bail is made out. The petition is rejected and the petitioner is directed to surrender to the Court below

Patna High Court CR. MISC. No.75830 of 2024(2) dt.18-04-2025 3/3 within six weeks from the date of this order and the Court below shall consider the prayer of the bail of the petitioner on the same day without being prejudice by this order.
