JUSTICE RAKESH KUMAR ORAL ORDER 17-11-2017 Heard Sri Anant Kumar Ojha, learned counsel, who has argued in presence of Sri Bachan Jee Ojha, learned counsel for the petitioners and Sri Yogendra Kumar Singh, learned Addl. Public Prosecutor.
Two petitioners, who are in custody since 23.08.2017 in Kutumba P.S. Case No.136 of 2017 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail.
It was submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in the present case on an accusation that they were involved in carrying liquor from Jharkhand and selling the same.
In view of the fact that the petitioners are in custody since
Patna High Court Cr.Misc. No.55411 of 2017(2) dt.17-11-2017 2/2 23.08.2017 as well as considering the nature of accusation, let both petitioners, namely, (I) Sanjay Choudhary (ii) Faujdari Bhuyian be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge VII-cum- Special Judge(Excise), Aurangabad in connection with Kutumba P.S. Case No.136/2017.
